Terms
Terms, and the health notice.
Last updated 2026-08-31.
Read this first, because it is the part that matters. Karate is physical exercise. Physical exercise carries a risk of injury, and that risk is higher if you are older, if you have a condition, or if you have not trained in a long time. Second Wind Karate is not medicine. Nothing here treats, cures, prevents or diagnoses anything. Talk to your own doctor before you start — particularly with a heart condition, a recent operation, a balance disorder, uncontrolled blood pressure, osteoporosis, or an injury that is still healing. If something hurts, stop.
Who we are
These terms are between you and [[LEGAL ENTITY NAME]] (“Second Wind Karate”, “we”), of [[POSTAL ADDRESS]]. Contact: [[CONTACT EMAIL]]. By using this site or joining the course you accept these terms. If you do not accept them, please do not use the site.
The health notice, in full
- We are not your doctors. Ori Shine is a qualified physician, and he appears on this site as one of the teachers and as the person who checked our reading of the research. He is not acting as your physician. Nothing on this site, in a live session, or in a reply from us creates a doctor–patient relationship, and none of it is medical advice, diagnosis or treatment.
- The research we cite is not about you. The studies listed on the research page are on tai chi, mindful movement and general exercise in older adults — not on this course. They are evidence for the principles the practice shares. They are not a prediction of what will happen to you.
- The welcome questions are not an assessment. When you first open your lessons we ask which movements are comfortable for you. It is not a test, not a screening, and not a health record; no one reviews it clinically. It only decides which version of a movement we show you first, and you can skip every question.
- You decide what you can do. We teach; you choose what to attempt. In a live session the teacher cannot see you the way someone in the room could, cannot assess your body, and cannot supervise you. Work within what your own doctor has told you.
- Stop and get help if you feel chest pain, breathlessness beyond ordinary exertion, dizziness, faintness, or pain that is sharp rather than tiring. If you think it is an emergency, call your local emergency number — do not write to us.
- You take part at your own risk. To the fullest extent the law allows, you accept the ordinary risks of physical activity, and you agree that we are not liable for injury arising from taking part, except where the law does not permit us to say so. [[A US attorney should check whether a separate signed waiver is needed before the first cohort, and whether your state limits waivers like this]]
The course
- What it is. A five-week course: one live hour a week with Eran, plus a shorter session with Ori every second week, in a group capped at fifteen. Sessions are recorded and the recordings go to members.
- Price. $250 for the five weeks, in US dollars, as a founding rate.
- Asking for a place is not buying one. The form on this site collects your details so we can write to you. Nothing is charged there. Places are limited and we may say no.
- Refunds. [[DECIDE AND STATE THIS PLAINLY. A clear money-back promise is the single strongest objection-killer for this audience — and once you take payment, US law expects your stated refund terms to be honoured. Suggested: full refund on request up to the end of week two, no questions asked.]]
- If we have to change things. If a session cannot run — illness, technical failure — we will reschedule it or provide a recording. If we cancel the course, you get your money back.
- Behaviour. A live session is a room with fourteen other people in it. Be civil. We may remove anyone who is not, and refund the unused part.
Recordings and your privacy in a live session
Live sessions are recorded so members can watch them back. If you are on camera, you may be in the recording. You may keep your camera off at any time and take part anyway. Recordings are shared with members of that cohort, and we will not publish a recording of you publicly — in an advertisement, on social media, on this site — without asking you first.
What belongs to whom
The videos, the written material, this site and its text are ours. Your membership is a personal, non-transferable licence to watch and learn from them. Please do not record, copy, re-post or resell them. You keep everything you send us; by sending us a testimonial you allow us to publish it with the name and detail you agree to, and you can withdraw that at any time.
Emails and calls
If you give us your email address we will write to you about Second Wind Karate. Every email has an unsubscribe link and we will stop as soon as you ask. If you give us your phone number we may call you about joining — that is the only reason we ask for it, it is always optional, and we will stop if you tell us to. See the privacy policy.
The site itself
We keep it accurate but we do not promise it is error-free or always available. Links to studies and other sites are for reference; we do not control them. To the fullest extent the law allows, the site is provided as-is, and our total liability to you is limited to what you have paid us.
Governing law
These terms are governed by the law of [[STATE — probably California, since Eran teaches from Los Angeles. An attorney should confirm, because it also decides where a dispute would be heard]], United States. Nothing here removes a right you have under the consumer law of the country you live in.
Changes
We may update these terms; the date at the top will change. If you have joined a cohort, the terms you joined under continue to apply to that cohort.
Note for Roy, not for the public. Written to be accurate and readable, but not reviewed by a lawyer, and I am not one. Two things here carry real money risk and should not go live on my judgement alone: the liability and waiver language (states differ on what a waiver can cover, especially for older participants), and the health claims made in the Benefits section and in Ori’s paragraph, which sit under FTC substantiation rules and, because Ori is licensed, potentially under his state medical board.
